This SMS Opt-In & Messaging Policy explains how Data Function Inc. (“Data Function”, “we”, “our” or “us”) asks for permission to send text messages, what those messages are about, how often we send them, and how you can stop them at any time. It applies to our text message program for consultations and appointments, called Data Function Consultation Messages. It should be read together with our Privacy Policy and Terms & Conditions.
Messages in this program are sent by Data Function Inc., a federally incorporated Canadian company based in Toronto, Ontario. Every message identifies Data Function Inc. as the sender.
We send text messages only about website and software consultations and appointments that you have asked for, and only after you have agreed to receive them. These messages may include:
These are service messages, not advertising. We do not send promotional text messages under this program (see section 9).
You can agree in either of these two ways. In both cases, saying yes is optional.
During a phone call with our team, a Data Function representative explains this program, reads the consent statement in section 11, and asks whether you agree to receive these text messages. We send messages only if you clearly say yes, and the representative documents your consent in our customer relationship management (CRM) system before any message is sent.
The contact form on our Contact page includes an optional checkbox for consultation text messages. The box is never ticked for you. You agree only by ticking it yourself before you send the form. The checkbox reads:
“I agree to receive text messages from Data Function Inc. regarding my consultation, including booking confirmations and reminders. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is optional. See our Privacy Policy and Terms & Conditions.”
We do not treat you as having agreed to text messages just because you called us, sent us a form, booked a consultation, gave us your phone number or bought a service from us.
Message frequency varies. We typically send one to four messages per appointment, for example a booking link, a confirmation, a reminder and, if needed, a rescheduling message. We may also reply when you text us.
Message and data rates may apply, depending on your mobile plan. Data Function does not charge you for these messages. Please contact your wireless provider for details about your plan.
You can stop text messages at any time by replying STOP to any message from us. We also accept UNSUBSCRIBE, CANCEL, END and QUIT, and we treat any other clear request to stop (for example “please stop texting me”) as an opt-out. After you opt out, you will receive one final message confirming that you have been unsubscribed, and we will not send you further messages under this program unless you agree again. You can also ask us to stop by emailing info@datafunction.ca or calling +1 416-319-3884. We act on STOP replies right away and on other requests promptly, and in any case within 10 business days.
If you change your mind later, you can reply START or contact us to opt back in.
Reply HELP to any message for help. You can also contact us at info@datafunction.ca or +1 416-319-3884.
Agreeing to receive text messages is not a condition of buying any product or service from Data Function. If you do not agree, we will contact you another way, for example by email or phone. You can withdraw your consent at any time as described in section 6. Withdrawing consent to text messages does not affect any services you have with us.
Agreeing to consultation and appointment messages does not mean you have agreed to receive promotional or marketing text messages. We do not send promotional text messages under this program. If we ever offer promotional text messages, we will ask for your separate, express consent, using a separate optional checkbox or a separate verbal request that clearly says the messages are promotional. We will never combine that request with your consent to appointment messages.
We do not sell, rent or share your mobile phone number, your SMS opt-in information or your consent records with third parties or affiliates for their own marketing or promotional purposes. We share this information only with the service providers that help us send and manage text messages (such as our SMS provider, Twilio) and only as needed to provide this service, or where the law requires it. Our Privacy Policy explains how we handle personal information.
Wireless carriers are not liable for delayed or undelivered messages.
This is the procedure our representatives follow when asking for consent to text messages during a phone call.
“Data Function Inc. can send you text messages about your requested website consultation, including booking links, confirmations, and appointment reminders. Message frequency varies, typically one to four messages per appointment. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is optional. Our Privacy Policy and Terms are available at datafunction.ca. Do you agree to receive these text messages?”
Calls placed through our CRM’s calling system are recorded after the caller hears a recording notice. Where a recording of the consent exists, it is kept with the customer’s record as additional evidence of consent. We keep consent and opt-out records for as long as we need them to honour your choices and to show that we had your permission.
Representative: “Great, I’ll set up your website consultation. Is 416-555-0123 the best mobile number for you?”
Customer: “Yes, that’s my cell.”
Representative: “Data Function Inc. can send you text messages about your requested website consultation, including booking links, confirmations, and appointment reminders. Message frequency varies, typically one to four messages per appointment. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is optional. Our Privacy Policy and Terms are available at datafunction.ca. Do you agree to receive these text messages?”
Customer: “Yes, I agree.”
Representative: “Thank you. I’ve noted that. You’ll get a text from us shortly confirming it, and you can reply STOP at any time.”
The representative then records the consent as described in step 5 and our first text confirms the enrollment. If the customer had said no, the representative would say that’s no problem, record that the customer declined, and continue by email or phone instead.
Verbal consent covers only the consultation and appointment messages described in this policy. It is not consent to promotional messages.
We may update this policy from time to time. When we do, we will change the “Last updated” date at the top of this page. If a change affects what you agreed to, we will ask for your consent again where the law requires it.
